These Terms & Conditions (“Terms”) govern your access to and use of the Sirius Technology Solutions website and the Dynamic Data Masking Framework (together, the “Services”). By accessing the Services or clicking “Accept”, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
1. Definitions
- “Sirius”, “we”, “us” — Sirius Technology Solutions.
- “You”, “Customer” — the individual or entity using the Services.
- “Platform” — the Dynamic Data Masking Framework software, including the proxy, admin portal, and any executables or updates we distribute.
2. License & use
Subject to these Terms and any applicable order or licence file, Sirius grants you a limited, non-exclusive, non-transferable, revocable right to use the Platform for your internal business purposes. The Platform is licensed, not sold. You may not exceed the scope of any licence (e.g. seats, term, or authorization type) provided with your deployment.
3. Acceptable use
You agree not to: (a) reverse engineer, decompile, or circumvent the Platform's security or licensing controls; (b) use the Services to violate any law or third-party right; (c) attempt to defeat or disable the data-masking controls to access data you are not authorized to see; (d) resell or sublicense the Services without our written consent; or (e) introduce malware or interfere with the integrity or performance of the Services.
4. Accounts & security
You are responsible for maintaining the confidentiality of any credentials and for all activity under your accounts. Notify us promptly of any unauthorized use. Administrative actions (including triggering software upgrades) are restricted to authorized administrators.
5. Software updates
The Platform may check for and, when you choose, install updates from our official release channels (stable, beta, dev). Updates are verified for integrity before installation. You are responsible for selecting an appropriate channel for your environment; pre-release (beta/dev) builds are provided “as is” for evaluation and may be unstable.
6. Intellectual property
The Services, including all software, content, and trademarks, are owned by Sirius or its licensors and are protected by intellectual-property laws. No rights are granted except as expressly set out in these Terms.
7. Customer data & privacy
Your use of the Services is also governed by our Privacy Policy. As between the parties, you retain all rights to your data. Where Sirius processes personal data within your databases, it does so as your processor and only on your documented instructions.
8. Service availability
We aim for high availability but do not warrant that the Services will be uninterrupted or error-free. We may modify, suspend, or discontinue features with reasonable notice where practicable.
9. Disclaimers
EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Data masking reduces but does not eliminate the risk of data exposure; you remain responsible for your overall security posture and compliance program.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIRIUS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO SIRIUS FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold Sirius harmless from claims arising out of your misuse of the Services or violation of these Terms or applicable law.
12. Term & termination
These Terms apply while you use the Services. We may suspend or terminate access for breach. Upon termination, your right to use the Platform ends and you must cease use and, where applicable, remove the software.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Sirius is established, without regard to conflict-of-laws rules. Courts of that jurisdiction will have exclusive jurisdiction, subject to any mandatory consumer-protection rights you may have locally.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will update the “Last updated” date and may require you to re-accept before continuing to use the Services.
